Calculating option notice cutoff dates accurately
A frequent error in commercial property management is focusing on the lease expiration date while overlooking the tenant’s option exercise window. If a lease term concludes on June 30, but the tenant must deliver written notice of renewal at least 180 days prior, the operative deadline is January 1.
If the tenant fails to deliver notice by the cutoff date, their legal right to renew on pre-agreed terms is extinguished, allowing the landlord to negotiate current market rental rates or remarket the space to prospective tenants.
- Expiration Date: The final day of the stated lease term
- Option Notice Window: Contractual period (e.g. 60, 90, 180 days) required to exercise renewal rights
- Cutoff Milestone: Expiration Date minus Option Notice Window — the true operational decision date
